Privacy Statement


This Privacy Statement describes the types of information that Ares Management Limited (“Ares”, "we" or "us") collect from and about you when you use this recruitment site ("the Site") and explains how we will use and disclose such information, as well as your ability to control certain uses of it. Please read this Privacy Statement carefully before using the Site.


This Site is not intended for use by children.  Please do not use this Site if you are under 16 years of age.


Information for recruiters


If you are a recruiter or other person submitting an application, resume or CV for consideration on behalf of person who is interested in a position posted on our Site, please ensure that you have provided him or her with a copy of this Privacy Statement, that you are authorised to submit his or her personal information to us, and you obtain any consent to information collection and use as set out in this Privacy Statement.


INFORMATION COLLECTION


Information we collect from you


We collect information from you when you provide it to us. This may include when you request information from us, use our recruitment services, use the Site or otherwise contact us.


If you provide us with details of referees, you confirm that your referees have consented to our collection, use and disclosure (including transfers to other countries as described in this Privacy Statement) of their personal information for the purposes of contacting them as referees, and being contacted by us in connection with your application.


Information we collect from others


The majority of the information processed by us is obtained directly from you or your use of our Site but some information may be obtained from others, including;


• recruiters or other persons acting on your behalf;

• publicly accessible sources (for example, tax codes from applicable tax authorities);

• previous employers or other references;

• educational establishments; and

• the Disclosure and Barring service or other local services disclosing criminal records data or providing background screening services.


What information we collect


The types of information that we process about you include your contact details and information you provide in your CV and application forms or letters.


If you are interested in any of the positions advertised on our Site, you should submit your CV and contact details or complete the online application form. We may also ask you to supply other personal information via the Site if this is relevant to a particular position or category of positions you are interested in.


Where relevant and permitted by applicable law, this information may include sensitive information, for example information regarding the commission of offences and related proceedings. You should only provide us with these types of information if you agree that we can process the information in accordance with the terms of this Privacy Statement (including the sharing of this information with others as described below). We may obtain this information from recruiters or persons acting on your behalf or from other sources (for example, from background screening services where permitted by local law).


Where the information you provide relates to someone else, you confirm that you have told them how we will use their information in accordance with this Privacy Statement and you have their consent to provide their information to us to use in accordance with this Privacy Statement.


Information we automatically collect through technology

INFORMATION USE


Why we collect your information


In relation to recruitment: We collect and process information about you when you use our Site to:


• contact you;

• assess your suitability for various roles and to administer your subsequent employment if your application is successful;

• ensure compliance with applicable laws and regulations;

• enable us to provide you with our services and conduct our business; and

• as otherwise described when you provide your information (or when information is provided on your behalf).


If we think you are suitable for any current vacancies or other opportunities, we will use your information to assess your suitability for roles you may be interested in and to inform you about these vacancies or opportunities.  If you submit a resume or CV through the Site or confirm your interest in an opportunity we will keep you informed by email as to the progress of your application and will use your information to manage the recruitment process.


For certain positions it may be necessary for us to verify the details you have supplied (for example, in relation to your academic credentials or your employment history) and/or carry out pre-employment checks in the event that we extend an employment offer (for example, in relation to previous criminal convictions). If a position that is or may be of interest to you requires pre-employment vetting, we will tell you about this. Such vetting will not usually occur unless and until an offer has been made. We will carry out background checks only where permitted by law and subject to your consent, if applicable.


Management of IT systems and infrastructure, improving our services and optimizing the user experience: As indicated above, we may also use the information we collect from and about you to:


• manage IT systems and infrastructure;

• develop new services or content;

• provide you with customized content;

• research, address problems, and improve the usage and operations of the Site;

• protect the security or integrity of the Site and our business; and

• as otherwise described when you provide your information (or when information is provided on your behalf).


Our legal basis for collecting and using your information


On some occasions, we process your information with your consent (including when you agree that we may place cookies other than those that are strictly necessary and in some cases where we process sensitive personal data). Where we process information based on consent, your consent is revocable at any time.


In other cases, the processing of your information is necessary:


• for compliance with legal obligations to which we are subject;

• for the purposes of carrying out obligations and exercising rights (either yours or ours) in the field of employment;

• for the performance of the employment contract; or

• for the establishment, exercise or defence of legal claims or where courts are acting in their judicial capacity.


We also process your information when it is in our legitimate interests to do this (including for the purposes of managing and facilitating the recruitment process) and when these interests are not overridden by your data protection rights.

 

Some information we collect is required in order for you to use the Site and/or apply for a role with Ares. As such, in certain circumstances, failure to provide information requested may impact your ability to use this Site and/or apply for a role with Ares.

 

We may disclose your personal information to:


  • our service providers, so that they can perform a business, professional or technical support function for us, including hosting the Site and related services, customizing your use of the Site based on your viewing patterns and areas of interest and verifying the status of your account;
  • entities that are a holding company or a subsidiary of Ares, or a subsidiary of Ares’ holding company (or a company managed or operated by any such holding company or subsidiary  (all such entities being the "Ares Group") for purposes set out in this Privacy Statement, including recruitment and human resource management purposes and for the purposes of compliance with applicable laws and regulations;
  • our background screening service providers;
  • recruitment agents;
  • as necessary if we believe that there has been a violation of our Site Terms of Use or of our rights or the rights of any third party;
  • to respond to judicial process or provide information to law enforcement or regulatory agencies or in connection with an investigation on matters related to public safety, as permitted by law, or otherwise as required by law; and
  • as otherwise described when you provide your information (or when information is provided on your behalf).
We may sell or purchase assets during the normal course of our business. If another entity acquires us or any of our assets, information we have collected about you may be transferred to such entity. In addition, if any bankruptcy or reorganization proceeding is brought by or against us, such information may be considered our asset and may be sold or transferred to third parties. Should such a sale or transfer occur, we will use reasonable efforts to require that the transferee use your personal information in a manner that is consistent with this Privacy Statement.

 

In addition, we may disclose your personal information to entities that are part the Ares Group if we believe they have job vacancies for which you may be eligible or which may be of interest to you.

 

INTERNATIONAL DATA TRANSFER

 

Your personal information may be accessed by Ares personnel and Ares Group personnel in the US  which is outside of the European Economic Area ("EEA"), to the extent necessary to manage and support our recruitment processes. Your personal information will be stored and processed manually and electronically through global systems and tools for this purpose. Intra-group transfers to outside the EEA are based on standard contractual clauses for the transfer of personal data from the Community to third countries which do not ensure an adequate level of data protection, approved by the European Commission. You have a right to ask us for a copy of these clauses (by contacting us as set out below).]

 

The Site is hosted in the US with access globally for the purposes of IT support.

 

Ares' background screening service provider may process personal information outside the EEA. Information regarding these transfers will be provided to you as appropriate if background screening is to be undertaken.

Some of the countries to which your information may be transferred may not have equivalent data protection legislation to that which applies in your own country.

 

INFORMATION RETENTION

 

Unless instructed otherwise or unless otherwise required by applicable law, we will retain information you have supplied to us for up to 3 years in order to contact you (including by email) about other suitable vacancies and opportunities which may become available from time to time. You should let us know if you do not wish us to retain your details so that we can consider you for other similar opportunities with us by emailing us at careers@aresmgmt.com. In all cases we will keep a record of your application, including resume or CV, for 9 months to deal with any matter which may arise in connection with your application. Details about successful applicants will be transferred to their employment files and information regarding retention periods may be shared with you at the point of employment, if applicable.

 

INFORMATION SECURITY

 

We are committed to maintaining the security of the information you provide to us and take appropriate technical, administrative, physical and procedural security measures, consistent with local and international information practices to protect your personal information from misuse, unauthorized access or disclosure, loss alteration or destruction.

 

We will ensure that the collection, use and protection of your information is in accordance with applicable law relating to privacy and data protection. We only keep your personal information for as long as it is necessary for us to provide the services you have requested, except where required by law to keep it for longer periods.

 

Because there is always some risk in transmitting information over the Internet, while we make every effort to help ensure the integrity and security of our network and systems, we cannot guarantee our security measures. Users of this Site are required to keep their password confidential as a loss of such password may lead to third party individuals accessing and amending data without their consent, for which we cannot be held liable.

 

LINKS TO OTHER SITES OR APPS

 

The Site may have links to third-party sites or applications, which may have privacy policies that differ from our own. When you use these links you will leave our website and enter sites we have no control over. This Privacy Statement does not cover your use of these sites or govern the personal information which you may provide. We are not responsible for the practices of such sites or applications. To protect your privacy, we suggest that you review the individual privacy statement on any third party website before using the site or submitting any personal information.

 

YOUR RIGHTS

 

You may under applicable law ask us for a copy of your information, to correct it, erase it or to transfer it to other organizations at your request. You may also have rights under applicable law to object to some processing and, where we have asked for your consent to process your information, to withdraw this consent. Where we process your information because we have a legitimate interest in doing so (as explained above), you also have a right to object to this. These rights may be limited in some situations – for example, where we can demonstrate that we have a legal requirement other legitimate grounds to process your information. If you wish to exercise these rights you should contact HROperations@aresmgmt.com. If you wish to access your personal information, where permitted, a fee may be chargeable. We may require verification of your identity when you seek to exercise your legal rights.

 

We will promptly take all reasonable steps to investigate any complaints or requests in relation to personal information. However, if you have unresolved concerns and believe that your rights have been breached, you also have the right to complain to the relevant supervisory body or seek a remedy through the courts.

 

Where we require personal information to comply with legal or contractual obligations, then the provision of such information is mandatory. If such information is not provided, please note that we may not be able to process your application or maintain our relationship with you, as applicable.
